Information about residential mobile home sites and licences required

Mobile Homes Act 2013: Fit and proper person

Site owners will need to make an application for us to assess if the person or company managing the caravan site is Fit and Proper. Detailed information about how the council makes its decision can be found in the Mobile Homes Act 2013- Fit and Proper Person Policy below.

If the application is approved, the site manager will be added to the register of Fit and Proper Persons for up to five years.

We will be checking that the site manager:

  • Is suitable to manage the site, for example they have relevant financial and managerial experience.
  • Has not committed any offences involving:
    • fraud or other dishonesty.
    • violence.
    • arson.
    • drugs.
    • certain sexual offences.
  • Has complied with relevant legislation relating to housing, caravan sites, mobile homes, public health, planning, environmental health or landlord and tenant law.
  • Has not broken the Equality Act 2010.
  • Has not been insolvent or disqualified from being a company director within the last 10 years.
  • Has the right to work in the UK.
  • Is a member of a complaints scheme which deals with complaints about the management of the site.

We will publish the following information on our public register:

  • The site manager’s name.
  • The site manager’s business contact details.
  • The site name and address.
  • Whether the applicant is a site owner or site manager.
  • Any conditions attached to the inclusion.
  • How long they are to be included in the register.
  • Rejected application information (until we grant a successful application for the site).

We will not include the site manager’s name if we reject the application.
If the application is approved, the site manager will be added to the register of Fit and Proper Persons for up to five years.

You will be committing a criminal offence if:

  • You do not apply for a licence by 1 October 2021.
  • You provide false or misleading information or withhold information from the application.
  • You fail to comply with a condition in the register.

If convicted the site owner could face an unlimited fine.

Preliminary decision

If we refuse the application or want to add conditions to the application, we will send you a preliminary decision notice. You will have 28 days to make any written representations if you do not agree with our preliminary decision notice.

This notice will tell you:

  • The reasons for the decision.
  • The date that the final decision will take effect.
  • Information about the right to make written representations.
  • Any consequences if you continue to use the land as a relevant protected site if we have refused the application.
  • The consequences of failing to comply with any conditions we impose on the application.

After the statutory 28 days we can make our final decision and we will send you a final decision notice.

The final decision notice will include:

  • The date of the final decision.
  • What the final decision is.
  • The reasons for the decision.
  • When the decision is to take effect.
  • Information about any right of appeal including timescales for appeal.
  • Any consequences if you continue to use the land as a relevant protected site if we have refused the application.
  • The consequences of failing to comply with any conditions we impose on the application.

Fit and proper person application and fees

Make an application

To make an application for a fit and proper person you will need to contact the residential services team at residential.services@rbwm.gov.uk to request an application form. The application will need to be accompanied by the relevant fee. Further information on what needs to be included in the application and how to pay, will be provided with the application.

Fees 

  • The council requires payment of a fixed fee at the point of submission of a fit and proper person application. 
  • The council will refuse to accept any application that is not accompanied by the appropriate fee. 
  • The fit and proper person application fee will be regularly reviewed and may be changed to reflect an increase or reduction in the council’s costs, so it is important that applicants review the fees and charges information before submitting their application and paying the fee.
  • The application fee for 2026-2027 is set at £226.94.
  • In the event the council rejects an application for inclusion on the fit and proper person register, the fee will not be refunded as the council will have incurred costs in processing the application. 
  • In arriving at the fee, the council has considered the average costs of determining a fit and proper person application from submission of the application, using officer hourly rates based on the salary levels of the officers involved in processing the applications. 
  • In setting the fees the council has excluded the costs of activities for which it is already charging a fee.

The matters the council have included in setting the fee are:

  • Review and validation checks on the initial application including any initial enquiries or communications.
  • Processing the application fee.
  • Communication with interested or third parties including, letters, emails, meetings, telephone calls.
  • Reviews of information and documentation.
  • Drafting and service of preliminary and final decision notices.
  • Drafting of conditions.
  • Review by manager and where appropriate, legal team.
  • Updating case management system.
  • Updating the public register and website.
  • Reviewing and dealing with appeals.

Where the council is contacted in advance of the submission of an application, it will provide general advice for which it will not charge a separate fee as the costs of providing advice have already been factored into the fee calculation.

Where inclusion on the register does not have any associated conditions, RBWM will not charge an annual registration fee.  Where conditions are attached to a registration, the council will require payment of an annual fee to cover the costs associated with monitoring compliance with conditions.

  • The fees, which are set out in Table one are based on the cost of:
    • correspondence with site owner, relevant persons or any third party in connection with the requirements of the condition(s).
    • updating files/computer systems and website if appropriate.
    • processing the annual fee.
    • reviewing documents and certificates; and
    • any other action required to ensure compliance with specific conditions e.g. visiting the site.

  • Where applicable payment of the annual fee will be a condition of continued registration, but the condition will be excluded from the count of conditions for the purposes of calculating the level of fee.  
  • Where applicable, annual fees will be payable on the anniversary of the inclusion on the register. The Council will write to the licence holder requesting payment.

Cost recovery where council appoints a Site Manager 

  • Where the council, with the site owner’s consent, appoints a site manager, the council can recover from the site owner reasonable costs it incurs. 
  • In advance of appointing a site manager, the council will seek to agree with the site owner, what costs will be recoverable. Some costs may be payable up-front. The council will seek the support of legal services in drafting a written agreement about the amount to be recovered and how it and when it will be paid. The council will take legal action to recover any unpaid costs.

The council is obliged to maintain a register of fit and proper persons, and those that have had their application for inclusion on the register rejected.

Conditions attached to registration
1. A written record of all complaints made to the site management team or licence holder must be made and retained for up to 24 months (from the date of the last action relating to that complaint). 

The record should include the following information:

- Date complaint received.
- Name and Contact details of complainant.
- Name and contact details of person receiving the complaint.

2. A copy of the complaints log must be provided to the Council within 14 days of a written request being sent to RBWM Council.
