The enforcement process

  1. Every enforcement case is different and how it progresses will depend on a number of factors including gaining access to the site, the willingness of those responsible to cooperate, the complexity of the issues being dealt with, appropriate use of resource and whether an appeal or legal challenge is mounted against formal enforcement action.
  2. The judgement of whether and/or when it is considered expedient to take enforcement action will also vary from case to case. Factors can include the impact on amenity of a breach or the level of investigation or evidence considered appropriate.
