Planning enforcement

Step 1 

Complaint received: Preliminary check undertaken and priority graded.

Step 2 

If breach suspected: officer allocated, acknowledgement sent and site visit undertaken.

Step 3

Has a breach of planning control occurred and if so, is it expedient to pursue?

• No breach identified: If planning permission is in place or works are permitted development. Case closed and complainant informed.
• Breach of planning control: Decision made on best course of enforcement action.

Step 4

Negotiate removal of breach:

• Failure to negotiate a remedy: Officer to prepare report for formal enforcement action under delegated authority. Once authorised, officer to serve notice and update parties. Breach ceases: Case closed and complainant informed.

Or:

Invite a retrospective application:

• Approved - Case closed and complainant informed.
• Refused - Officer to prepare report for formal enforcement action under delegated authority. Once authorised, officer to serve notice and update parties.

Step 5

Appeal stage

• No appeal submitted – notice takes effect - Site visit to check for compliance: 

  - Requirements complied with, case closed and complainant informed.
  - Requirements not complied with, proceed to prosecution for non-compliance.

• Appeal submitted and allowed  

  - Case closed and complainant informed.

• Appeal submitted and dismissed - Site visit to check for compliance:

  - Requirements complied with, case closed and complainant informed.
  - Requirements not complied with, proceed to prosecution for non-compliance.
