Lawful basis for processing information

General Data Protection Regulation Article 6(1)(e) – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

We process your personal data as part of our duties to consult on the three-yearly review of the RBWM Gambling Act 2005 Statement of Principles 2019 – 2022. This enables us to perform the statutory duties of the Gambling Act 2005. 

How we collect information

We collect information from residents, individuals, businesses and internal and external partners.

We collect the information in a number of ways:

  • paper or electronic forms or letters;
  • email;
  • telephone; 
  • via the RBWM website; 
  • social media;
  • face to face (via our employees or partners).

What information is collected

“Personal data” is any information about a living individual, which allows them to be identified from that data (for example a name, photographs, videos, email address, or address).
Identification can be by directly using the data itself or by combining it with other information, which helps to identify a living individual.

Personal information is included in representations made by people, businesses or organisations who contribute to this consultation process.

This will include names, characteristics (such as gender), addresses (including email), telephone number, trading details of businesses and details of organisations. 

How we use the information provided

  • The information you provide will enable us to carry out the required statutory consultation
  • The information will also help us review our current policy.

Who has access to the information about you

We store your personal data securely. We have in place security policies which are intended to ensure, as far as possible, the security and integrity of all personally identifiable information. 

Only members of the Licensing team involved in the consultation process will have access to your personal data for the purposes of reviewing our current policy. 

Who we may share your information with

Where necessary and lawful, or when required by legal obligation, we may share information with other teams in the Royal Borough of Windsor and Maidenhead or with partnership agencies.

We only share information internally with other departments such as Highways or Parking services, where the information we hold will be used as evidence to assist with these departments’ investigations and statutory duties. We may need to share information with Thames Valley Police upon request concerning evidence of criminal offences, for example, to assist in their law enforcement duties.  

How long we store your information

The policy will be reviewed and republished by 31 January 2022. Your personal data will not be held beyond this date.
