Lawful basis for processing information

Anti-social Behaviour, Crime and Policing Act 2014

General Data Protection Regulation Article 6(1)(e) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

General Data Protection Regulation Article 6(f) processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.

How we collect information

Public Spaces Protection Orders (PSPOs) propose to deal with nuisance in a particular area which are having a detrimental effect on the quality of life for those in the local community. They can prohibit certain things from taking place or require specific things to be done.

We are proposing the introduction of 2 new PSPOs to tackle catapulting across the Borough and street selling on during Ascot racecourse. 

We are seeking the views of residents and visitors of the Borough via the consultation to gauge whether there is enough support for PSPOs to be put in place. The public consultation is a statutory requirement. A PSPO cannot legally be put in place without a consultation. 

We collect personal data directly from residents when they participate in the consultation process.

How we use the information provided

Information provided by residents as part of the consultation will be anonymised and collated to create our consultation report to highlight which age group and location base are engaged with us and have an interest in community safety issues.

Community Safety/Housing and Public Protection staff members.

Who we may share your information with

Personal data collected from residents is not shared any wider than the Housing and Public Protection team.

How long we store your information

Your personal data is held by the team for 12 months and is then securely destroyed.
