Lawful basis for processing the information

General Data Protection Regulation Article 6(1)(e) – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

This authority arises from statutory duties under the Self-Build and Custom Housebuilding Act.

Under the Self-Build and Custom Housebuilding Act 2015 (as amended), the Council is required to keep a register of individuals and associations seeking land for self-build or custom housebuilding and use this information to help assess demand and inform planning policy.
 

How we collect information

Information is provided by applicants on paper forms directly by you when you complete the registration form (either paper or online).

Information we collect

We collect the information you provide on the Self-Build and Custom Housebuilding form, which may include:
•    Name.
•    Address.
•    Email address and phone number.
•    Nationality, and if you have dual nationality.
•    Occupation.
•    Type of plot sought and preferred location.
•    Preferred property type.
•    Budget and method of financing.
•    Anticipated build progress timescale.
•    Any other information you supply that is relevant to your application.

How we use the information provided

We use your information to:

•    Maintain a register of those interested in self-build and custom-build opportunities within the Borough. 
•    Understand demand for plots and inform planning policy.
•    Support the identification of potential serviced plots in the borough.

We may use anonymised data from the Self-Build Register to prepare periodic assessments of demand, including the Council’s Self-Build and Custom Build Need and Supply Statement.

We also provide anonymised annual statistical returns to the UK Government to support national monitoring of self-build and custom-build activity. 

No individuals can be identified from this anonymised data. 

Who has access to the information about you

Your information may be accessed by relevant internal Council teams, including:

•    Planning Policy.
•    Housing Services.

Who we may share your information with

We may share your information with:

•    Developers or landowners offering suitable self-build plots that align with your stated preferences.
•    Relevant Council teams involved in planning and infrastructure delivery, including the CIL team and Development Management, where it is necessary to support statutory planning functions.  

Anonymised data may be published to support policy monitoring.

We will not share identifiable information with anyone else unless we are legally required to or you give explicit consent.

How long we store your information

We retain your information for no longer than necessary, and for a maximum of eight years, to support statutory monitoring cycles and planning policy duties.

You may request removal from the register at any time. 

Does your service utilise automated decision making? – No.
