I am writing to ask for assistance in locating historical records held by the Royal Borough of Windsor and Maidenhead concerning land at Charters Road, Sunningdale, formerly known as [property] and now known as [property address].

I am researching the history of the restrictive covenants affecting the former Charters Road development and, in particular, the Council’s historical involvement with Tagshaw Limited and [name].

I would be very grateful if the Council could search its historical records for any documents, correspondence or files relating to:

- Tagshaw Limited and its development of land at Charters Road, Sunningdale;
- [name] and any dealings or correspondence between him and the Council concerning [property] or the surrounding land;
- the Transfer dated 29 July 1983 between the Council and Tagshaw Limited;
- the restrictive covenants contained in, or arising from, that transfer;
- any records identifying the land or properties which were intended to benefit from those restrictive covenants;
- original plans, schedules, maps or other documents showing the land intended to benefit from the covenants;
- correspondence concerning the interpretation, enforcement, release, waiver or variation of those covenants;
- correspondence between the Council and Tagshaw Limited, [name], previous owners or neighbouring owners concerning the covenants or the Charters Road development;
- any historical records concerning [property] Charters Way and the other properties forming part of the development;
- planning application 471742, including any correspondence or documents referring to restrictive covenants;
- the Deed of Release dated 11 January 1996 between the Council and [name], together with any internal Council file relating to that deed;
- any internal reports, legal correspondence, approvals, valuations, committee papers or other records concerning the Council’s decision to enter into the 1996 Deed of Release; and
- any earlier or subsequent agreements, releases or correspondence concerning these restrictive covenants.

I am particularly interested in understanding what the Council’s historical records show about which land was considered to benefit from the restrictive covenants created in connection with the 1983 transfer, and what land the Council understood to be covered by the subsequent releases.

The reason for my enquiry is that the 11 January 1996 Deed of Release expressly refers to the 29 July 1983 transfer and to a covenant intended to benefit the Council’s retained, adjoining or adjacent land. The plan attached to the deed also appears to include land which is now registered under title BK331115.

I have obtained copies of various historical Land Registry documents, but I am now trying to establish whether the Council holds the underlying historical correspondence and files which may explain the background to these transactions.

I am not asking the Council to provide a legal opinion on the present enforceability of any covenant. I am simply seeking the historical documentary records held by the Council, including correspondence, plans, reports and other records which may help establish what the Council understood and recorded at the time.

If these records are held by a different department, archive or external repository, I would be grateful if you could forward this enquiry to the appropriate team or let me know who I should contact.

I would also be grateful if you could confirm whether the Council retains any historical legal, property, land charges or estate files concerning Tagshaw Limited, [name], the Charters Road development or the 1983 transfer.
