RE: Site Allocation AL39 (Land to the Rear of London Road, Datchet)
Please accept this formal request for information under the Freedom of Information Act 2000 (FOIA) and, where applicable, the Environmental Information Regulations 2004 (EIR).
This request pertains specifically to the ongoing discharge of planning conditions, technical evaluations and the negotiation or drafting of the Section 278 Highway Agreement for planning application 22/02737/FULL (and all associated variations, including 25/01583/VAR and 26/00828).
I require the disclosure of all recorded information held by the Council from 1st January 2022 to the date of this email regarding the following items:
1. Equality Impact Assessments (EqIA): Any formal Equality Impact Assessment, Equality Analysis or recorded internal compliance reviews undertaken by or on behalf of RBWM concerning the Public Sector Equality Duty (Section 149 of the Equality Act 2010) in relation to the off-site highway layouts, pedestrian connectivity and the northern infrastructure provisions for Site AL39.
2. Active Travel & LTN 1/20 Audits: Any active travel compliance assessments, Route Check Tool outputs, or LTN 1/20 compliance audits held by the Highways Development Control or infrastructure teams concerning the Riding Court Road corridor and its connection to the AL39 site.
3. Internal Technical Correspondence: All internal emails, meeting minutes, memos, and technical notes exchanged between RBWM Highways Development Control, the Planning Department, and the developer’s engineers regarding the northern pedestrian infrastructure deficit, pedestrian safety on the M4 over-bridge approach, or the spatial constraints on Riding Court Road.
Public Interest and Harm Test
If the Council intends to rely on any exemptions under the FOIA or exceptions under the EIR to withhold any part of this information, please note that there is an overwhelming public interest in the safety of the public highway, statutory compliance with the Equality Act 2010 and the transparent spending of infrastructure-related developer contributions.
