This is a request for information under the Freedom of Information Act 2000, and/or the Environmental Information Regulations 2004 where applicable, which the council should apply as appropriate to the subject matter.
It concerns the criteria the council applies when deciding whether to take enforcement action against a landowner or occupier where hardcore, rubble or similar inert material has been deposited on land.
Please provide the recorded information held by the council that answers each of the following:
1. What is the current criteria or threshold the council applies when deciding whether to take enforcement action against a landowner or occupier for the deposit of hardcore, rubble or similar inert material on their land? Please state the threshold whether it is expressed quantitatively (for example by volume, area or quantity of material) or qualitatively (for example by reference to harm, amenity, or the expediency of enforcement), and provide a copy of, or a link to, any policy, guidance or written criteria in which it is recorded.
2. Does the council apply different criteria or thresholds depending on whether the matter is handled as a planning enforcement issue or as an environmental health / waste (fly-tipping) issue, and/or whether the land is designated as green belt? If so, please state each, and provide the relevant recorded criteria for each.
3. Have thresholds or criteria changed at any point in the last five years? For each change, please state the date it changed, what the previous threshold or criteria was, and, if recorded, the reason for the change.
