I am requesting recorded information under the Freedom of Information Act 2000 and/or the Environmental Information Regulations 2004.

This request relates to the applications listed below, each of which is subject to a completed section 106 agreement. I am not requesting copies of the agreements or of the planning-condition discharge records, both of which I hold. I am requesting only the Council's records of the discharge/compliance status of the section 106 obligations that must be satisfied before development may lawfully commence.

For each application, in respect of every section 106 obligation expressed to be satisfied, submitted or approved prior to commencement of development, please provide:

(a) whether the developer has submitted or applied to discharge or satisfy that obligation, and the date of any such submission; and
(b) whether and when the Council approved, discharged or recorded satisfaction of it.

By way of example, such pre-commencement obligations commonly include written approval of a travel plan (and any associated checking fee), approval or notification of the affordable-housing provider, payment of off-site highways or infrastructure contributions due before commencement, land transfers, registered-provider nomination agreements, and execution of any confirmatory or supplemental deed binding each phase. Please address each such obligation in the relevant agreement.

Where the Council maintains a section 106 monitoring record or Infrastructure Funding Statement working data capturing this, a copy or extract for the listed sites would satisfy the request.
