Request

Please treat this as a request under the Environmental Information Regulations 2004 (EIR). The information requested below relates directly to the state of the air and to measures affecting the air and the residential environment at and around The Loftings development, Stafferton Way, Maidenhead, and therefore falls within the definition of environmental information at Regulation 2(1).
For ease of processing I have grouped the request under headings. All requests cover the period from the relevant document date to the present, unless otherwise stated.

The odour assessment for planning application 14/03765/FULL

1.1. The full Waterman Energy, Environment and Design Limited Odour Assessment, document reference EED14444-100-R-1.1.4_EC, dated October 2014, prepared for Harrow Estates plc, in the form held by the council, including all appendices and the Silsoe Odours Ltd monitoring survey report dated 20 May 2014.
1.2. Any earlier or later versions of that odour assessment held by the council, including the May 2014 and July 2014 issues referenced on the document control sheet.
1.3. The council's Environmental Health consultee response to application 14/03765/FULL, including any internal officer notes, comments, or memoranda concerning the odour assessment.
1.4. All correspondence between the council and Waterman Energy, Environment and Design, Silsoe Odours Ltd, Harrow Estates plc, Turley, or any other party representing the applicant, concerning the methodology, scope, or conclusions of the odour assessment between 1 January 2014 and 30 June 2015. This includes the email exchange between Erwan Corfa of Waterman and Feliciano Cirimele of the council on 8 April 2014, and any follow-up communications.
1.5. Any communication between the council and Michele Speed (named in the 8 April 2014 email as the area officer) concerning the proposed odour assessment.
1.6. Any internal council correspondence or notes considering whether the scoping-out of the Vicus Way waste transfer station from the Waterman assessment (paragraph 2.3 of the October 2014 report) was appropriate.

Determination of planning application 14/03765/FULL

2.1. The full Planning Officer's Report to Committee, or the equivalent delegated decision report, for application 14/03765/FULL, including any addenda, updates, or supplementary reports.
2.2. The minutes of any planning committee meeting at which application 14/03765/FULL was considered, together with the agenda papers as circulated to members.
2.3. The wording of any draft conditions considered during the determination of 14/03765/FULL that were not ultimately imposed, together with any officer notes explaining why specific wording was adopted for Condition 25 (Odour Mitigation).
2.4. Any internal correspondence between Planning, Environmental Health, and Legal Services concerning the wording, scope, or enforceability of Condition 25 during the determination of 14/03765/FULL.

Discharge of Condition 25 (application 16/00357/CONDIT, approved 3 February 2017)

3.1. The full application file for 16/00357/CONDIT in relation to Condition 25 only, including all submitted documents, letters, and drawings.
3.2. The letter from Envirovent referenced in the 3 February 2017 decision notice as setting out "the details of the carbon filters", in full.
3.3. Any layout plan, schedule of accommodation, or plot list submitted with or referenced in the discharge of Condition 25, identifying the plots to be fitted with mechanical ventilation with carbon filters.
3.4. The council officer's assessment, report, or notes recommending approval of Condition 25 at discharge stage.
3.5. Any internal council correspondence or consultation with Environmental Health on the discharge of Condition 25.
3.6. Any consideration recorded in writing of whether the recommendation in paragraph 6.2 of the Waterman odour assessment (limiting carbon filters to plots 139 to 144, 154/155, and Block H) was consistent with the wording of Condition 25, which required mitigation "throughout the development".
3.7. Any record of correspondence between the council and the applicant, agent, or developer concerning whether Condition 25 would apply to all 271 dwellings or only to a subset.

Plot identification at The Loftings

4.1. The plot numbering layout plan submitted with or referenced in application 14/03765/FULL, identifying each plot by number across the site.
4.2. Any document held by the council that maps the developer plot numbers used in the Waterman odour assessment and the Envirovent specification (plots 139 to 144, 154/155, and Block H) onto the as-built block names and street addresses of the completed development (Orchid House and the other buildings at The Loftings).
4.3. Specifically, please confirm whether Apartment 23 Orchid House, Vicus Way, Maidenhead, SL6 1EG, corresponds to any of the plots identified in the Waterman odour assessment at paragraph 6.2 or in the Envirovent letter as requiring mechanical ventilation with carbon filters under Condition 25 as discharged.

Post-discharge compliance with Condition 25

5.1. Any building control records, inspection reports, or completion certificates relating to the installation of mechanical ventilation with carbon filters at The Loftings.
5.2. Any commissioning certificates, operation and maintenance manuals, or maintenance records held by the council for the carbon-filtered ventilation systems at The Loftings.
5.3. Any planning enforcement enquiries, complaints, or investigations concerning compliance with Condition 25 of 14/03765/FULL since 3 February 2017.
5.4. Any correspondence between the council and the freeholder, managing agent, or any resident of The Loftings concerning the installation, operation, or maintenance of the Condition 25 ventilation system since 3 February 2017.

Pre-application and consultee history

6.1. Any pre-application advice given by the council to Harrow Estates plc, Turley, or any agent acting for the applicant in respect of the Stafferton Way site between 1 January 2013 and 8 December 2014, in relation to odour, air quality, or proximity to the adjacent waste transfer station and sewage treatment works.
6.2. The consultee responses received from the Environment Agency, Thames Water, and Veolia (or any predecessor or successor operator of the waste transfer station) in respect of application 14/03765/FULL.
6.3. Any internal council document considering the cumulative impact on residential amenity of the Stafferton Way site's proximity to both the Maidenhead Sewage Treatment Works and the Vicus Way waste transfer station.

Land charges and buyer disclosure

7.1. The standard CON29 search response template entries used by the council for the addresses at The Loftings since first occupation, in relation to planning conditions, environmental notices, or proximity to permitted waste facilities.
7.2. Any LLC1 Local Land Charges register entries currently in force in respect of The Loftings addresses relating to Condition 25 or to odour, noise, or other environmental conditions.

Subsequent consideration of the planning history in the context of complaints

8.1. Any internal council correspondence, briefing note, or report between 1 January 2024 and the date of this request referring to Condition 25 of 14/03765/FULL in the context of resident complaints about the Vicus Way waste transfer station.
8.2. The basis on which the Stage 1 complaint response of 16 September 2025 (reference COM002827) raised the question of whether the complainant was using the building ventilation system provided under Condition 25, and any internal record of the council having verified, before issuing that response, that Condition 25 mitigation applied to the complainant's dwelling.
Procedural points
I would be grateful if the council would process this request under the EIR 2004. If any element is considered to fall outside the EIR, please process those elements under the Freedom of Information Act 2000 and identify which regime has been applied to each element.
If the council intends to refuse any element of the request, please cite the specific exception relied on and provide the public interest analysis required under Regulation 12(1)(b).
