RBWM Local Elections
Please note that RBWM run local elections every four years. The next Local Elections for RBWM is scheduled for Thursday 6 May 2027.
I am writing to request information under the Freedom of Information Act 2000 in relation to the lease of Riverside Gardens, Maidenhead to Jenners Catering Limited.
I refer to your previous responses (FOI002691, FOI002703 and FOI002825), which indicate that no rent has been received during the term of the lease and that public convenience costs have been set against rental liabilities.
To understand how the lease has operated in practice, please provide the following:
1. Rent records
Any records held showing rent due, any adjustments made, and rent received for each year of the lease, including any rent account records, statements, or other financial records supporting the Council’s position that no rent has been received.
2. Public convenience costs and application
Any records showing the costs of maintaining the public conveniences and how these costs were applied to reduce rent payable, including the application of the 80% of total cost provision and £3,500 threshold, as per lease contract.
Please confirm whether, in any year, rent was reduced to £0, and if so, explain how this accords with the lease provision that rent should not be reduced to nil
3. Turnover information
Any records held of gross turnover declarations, or any requests made by the Council for such information, in accordance with the lease terms.
4. Indexation
Confirmation of whether the £5,000 rent and the £3,500 figure referred to in the lease were subject to RPI indexation, together with any records showing how this was applied.
5. Absence of records
If any of the above information is not held and was not ever held, please confirm this.
