I write to request disclosure of information pursuant to the Environmental Information
Regulations 2004 (“EIR 2004”), on the basis that the information requested relates to matters of land use, built environment, public access, infrastructure servicing, environmental risk and public safety, all of which fall squarely within the scope of the Regulations.
This request concerns the disposal of the Royal Borough of Windsor and Maidenhead’s freehold interest to Derno Estates Limited completed on 12 January 2022, being land registered under title number BK519370, including the land comprising 22A–32A High Street and St Mary’s Walk, Maidenhead.
Scope of Request
Please provide copies of all recorded information held by the Council, in any form, including but not limited to letters, emails, attachments, internal correspondence, reports, memoranda,
meeting notes, briefing papers, cabinet/committee documentation, valuation material, legal
advice summaries, draft documents, negotiations, correspondence with third parties and records of decision-making relating to:
1. The decision to dispose of the freehold interest, including internal and external
correspondence, cabinet or committee reports, officer recommendations, due diligence
materials and governance assessments.
2. The drafting, negotiation and inclusion of restrictive covenants, title restrictions and
obligations within the Transfer dated 12 January 2022, including the rationale for the
continuing control provisions and any discussion concerning Clause 17 compliance
requirements and related disposal restrictions.
3. Any reference to building safety, environmental risk, fire safety, means of escape, refuse
provision, access routes, service yard provision, infrastructure servicing, public safety considerations or estate management obligations, whether operational or strategic,
considered in the course of the disposal process.
4. Any correspondence or negotiations with Derno Estates Limited, The Freshwater Group,
or their agents or representatives, relating to the disposal, continuing obligations,
enforceability of terms, or concerns over management, accountability, or compliance
with planning and property-related obligations.
5. The Section 106 Agreement dated 31 March 2015, together with any internal
assessments, monitoring records, enforcement consideration, compliance discussions or
integration of that Agreement with the 2022 disposal.
