This request relates to the Section 106 Agreement dated 16 January 2012 concerning Windsor Fitness and Squash Club, Clarence Road/Helston Lane, Windsor (planning application 11/00403).
This agreement (copy attached) secured:
• a Reprovision Contribution of £270,000 for the reprovision of three or more new squash courts as part of a leisure facility; and
• a separate Developer Contribution of £103,791 for library, public open space, economic development and administration/monitoring.
I understand that only a small percentage of the £270,000 Reprovision Contribution has so far been spent or allocated by RBWM.
Under the legislation governing freedom of information, I now request the following information:
1. Confirmation of all payments received under the Reprovision Contribution (£270,000) and Developer Contribution (£103,791), including dates and amounts.
2. A detailed breakdown of how any and all monies from the Reprovision Contribution have been spent, committed or allocated, including for each item:
§ Project name/location
§ Amount
§ Date of decision
§ and purpose.
3. Copies of any officer reports, decision notices, internal approval forms or committee papers that authorised expenditure or allocation of any part of the £270,000 Reprovision Contribution, particularly any monies already spent/allocated.
4. Entries from RBWM’s Section 106 / developer contributions monitoring system or database for this S106 agreement showing the income, allocations, expenditure and any remaining balance for the Reprovision Contribution and Developer Contribution.
5. The current remaining balance (if any) of the Reprovision Contribution, and details of any projects for which the remaining funds are earmarked, together with any “clawback” or repayment provisions and relevant dates.
