I am writing under the Freedom of Information Act 2000 (and, where relevant, the Environmental Information Regulations 2004) to request information held by the Royal Borough of Windsor and Maidenhead (RBWM) concerning applications to stop up or divert highway land under Sections 116 and 117 of the Highways Act 1980 made at the request of private landowners or householders within the last five years (1 January 2019 – present).
Please provide the following information:
1. Details of all Section 116 / Section 117 applications made during this period where the initiating party was a private individual or landowner (i.e. not a property developer, utility company, or highway scheme).
2. For each such application:
o The location/address of the land concerned;
o The type of highway affected (e.g., verge, footway, alleyway, etc.);
o The outcome (granted, refused, withdrawn, or pending);
o The date of any Magistrates’ Court hearing and decision (if available);
o Whether any objections were received (in anonymised or summary form); and
o The grounds or reasoning recorded by the Council or Court (if held).
3. Copies (or redacted extracts) of any Council officer reports, Legal Services briefings, or committee minutes referring to those private-initiated s116/s117 applications.
4. The Council’s current procedure or policy for dealing with private requests under Section 117, including indicative timescales and fee structure.
