Lawful basis for processing the information
General Data Protection Regulation Article 6(1)(c) processing is necessary for compliance with a legal obligation to which the controller is subject.
Our additional legal basis for using your special category information is:
- processing is necessary for the purposes of carrying out the obligations and exercising specific rights of the controller or of the data subject in the field of employment and social security and social protection law in so far as it is authorised by Union or Member State law or a collective agreement pursuant to Member State law providing for appropriate safeguards for the fundamental rights and the interests of the data subject
Duty to Refer, this part of the Bill (in Clause 10):
- Requires public authorities in England specified in regulations to notify a local housing authority (LHA) of service users they think may be homeless or at risk of becoming homeless.
- Requires the public authority to have consent from the individual before referring them, and allows the individual to choose which LHA they are referred to.
How we collect information
We will collect your information using a paper form, digitally, by telephone, in person (face to face) during assessments, observations and via email.
What information is collected
We will collect your Names, addresses, phone numbers, email addresses, date of Birth, financial information, payroll, bank details, credit card information, universal credit and other government benefit payments, sexual orientation, information relating to health and medical information, information about risk to public and convictions or offences, Biometric data (proof of identity), information relating to partners and co-dependents.
How we use the information provided
We are collecting your information to allow us to fulfil our Duty to Refer (under section 213B of the Housing Act 1996). Other public authorities are required to refer anyone who is homeless or at risk of becoming homeless to us. We can then assist and support you with your homelessness.

Our Housing and Rough Sleeper team.
Who we may share your information with
Your information can be shared with shared with Police, GPs, Mental health team, other local housing authorities in Berkshire. We also work with support agencies and third parties which relate to you directly and may be required to share your information with them in order to allow them to provide their services.
How long we store your information
We will keep your personal information for the duration of your use of our services.
Other personal information is retained for specific periods defined by legislation and in line with RBWM privacy notice, 10 years.
