Managing agents operating within the Royal Borough of Windsor and Maidenhead are responsible for ensuring that waste arising from managed properties is stored, presented, and disposed of in accordance with RBWM collection policies and the Environmental Protection Act 1990. Failure to do so may result in missed collections, enforcement action, or fixed penalty notices.
Managing agents must ensure that correct bins and services are in place with the appropriate RBWM‑approved containers, including:
- Residual (rubbish) bins – collected weekly.
- Dry mixed recycling bins – collected weekly.
- Food waste containers – collected weekly.
Overflowing bins, side waste, or incorrectly presented containers may not be collected, and the managing agent is expected to resolve these issues before the next collection date. This includes contaminated recycling bins which will not be emptied until the contamination is removed.
Fly‑tipping is a criminal offence. RBWM issues fixed penalty notices and may prosecute offenders, with fines of up to £50,000 for serious cases. Where fly‑tipping occurs on private land or communal areas, responsibility for removal lies with the landowner or their managing agent, not RBWM. This includes fly tipping within bin store areas, or any land which forms part of a managed development.
If managing agents fail to meet their responsibilities, RBWM may:
- Refuse to collect contaminated or improperly presented bins.
- Issue fixed penalty notices for waste offences.
- Require clearance of waste at the landowner’s expense.
