It is proposed that the pavilion will be let on a leasehold basis on the following terms and conditions:
The tenant shall enter into a formal lease with the Council, which may contain other terms and conditions deemed necessary to protect the Council's interest. The length of lease is negotiable.
The premises have consent within D1 of the Use Classes Order 2005 and may be used as a crèche, day nursery or day centre. Interested parties are advised to check with the Council's Planning Department for details of further acceptable uses within this Use Class. The Council will consider all expressions of interest and offers for the property.
It should be noted that the successful party will be expected to operate all of the facilities within the building including the café and open it to the public and that they will keep the toilets open during the opening hours of the park. Any change of use will require the Council's consent as landlord and will be subject to the tenant obtaining the necessary Planning Consent.
The tenant will be responsible for both internal and external repairs and maintenance to the pavilion including the public toilets and for the clearance of litter from the external seating areas
The tenant will be responsible for all outgoings including business rates arising throughout the term.
The tenant shall be expected to bear the Council's Surveyors and legal fees incurred in the preparation of this lease.
The tenant will be permitted to assign the premises, sub-let or otherwise part with possession subject to securing the Council's consent.
The tenant will need to seek the Council's consent prior to making any structural alterations.
The Council will insure the structure of the building and recharge the premium to the tenant. The tenant will be required to insure against damage and the loss of contents.
Rental offers are invited for the pavilion, which will be payable quarterly in advance.
