Unauthorised Traveller development at Shurlock Road

The council sent its response to the High Court on Thursday 2 May following an application for permission to judicially review the council's decision to take direct action at the unauthorised traveller development at Shurlock Road, Waltham St Lawrence.

The council received a High Court order on Thursday 11 April prohibiting direct action which immediately halted the site clearance planned for Monday 15 April. This order was accompanied by an application, by lawyers for two of the occupants, for permission to judicially review the decision to take direct action. The council was given 21 days to respond.

In addition, on Wednesday 30 April the council was served with a second application, this time for permission to judicially review the council's decision to decline to determine a planning application for one of the occupants on the unauthorised site. Again the council has 21 days in which to formulate a response.

The prohibition will remain in place until the court determines whether to give permission for the applications for judicial review or issues a further order. It is up to the court to decide how matters proceed from there.

Cllr MJ Saunders, cabinet member for planning and property, said: "We are not expecting a response soon as the average time for a decision can be about 11 weeks.

"If the court decides there are grounds for a judicial review, or issues a further order, then of course it could take a lot longer until the legal process is complete.

"We will as always follow the due and proper process of the law. At the same time we remain in contact with the travellers and will seek to ensure that no further incursions take place."
