YOU ARE HEREBY SUMMONED TO ATTEND the Meeting of the Council of the Royal Borough of Windsor & Maidenhead to be held in the Main Hall, Manor Green School, Elizabeth Hawkes Way, Maidenhead, on Tuesday 27 July 2010 at 7.00 pm for the purpose of transacting the business specified in the Agenda set out hereunder.

1. APOLOGIES FOR ABSENCE - To receive any apologies for absence.

2. COUNCIL MINUTES - To receive the minutes of the meetings of the Council held on 22 June 2010

3. DECLARATIONS OF INTEREST - To receive declarations of interests in respect of any item to be considered at this meeting.

4. MAYOR'S ANNOUNCEMENTS (18kb PDF) - To receive such communications as the Mayor may desire to place before the Council.

5. PUBLIC QUESTIONS

a) Mr Ewan Larcombe of Lawn Close, Datchet will ask the following question of Councillor Rayner, the Lead Member for Highways and Streetcare:

I suspect that the Environment Agency is likely to suffer budget cuts of some £750m and will thus be claiming that there are no funds for flood defence. The EA is already asking for local authorities to fund their own flood defences. Having taken powers over the Critical Ordinary Watercourses and then abandoned maintenance, I believe the probability of flooding is increasing. What action do you intend to take to avoid danger to local residents?

b) Mr Ewan Larcombe of Lawn Close, Datchet will ask the following question of Councillor Rayner, the Lead Member for Highways and Streetcare:

The Flood Risk Regulations 2009 No. 3042 designate the RBWM as the 'lead local flood authority'. There is now a duty to prepare preliminary assessment maps and preliminary assessment reports for each river basin district which must be published before 22nd December 2011. What will RBWM report about River Thames conveyance capacity and in particular dredging?

6.PETITIONS - To receive any petitions presented by Members on behalf of registered electors for the Borough under Rule A.10.

7. INITIAL REVIEW OF THE CONSTITUTION (59 kb PDF) - To consider a report on an initial review of the Constitution.

8. MEMBERS' QUESTIONS - To receive Questions submitted under Rule 11.2

a) Question submitted by Councillor Harris to Councillor Dudley, Lead Member for Adult and Community Services:

Can the Lead Member update me on the situation with regards to the construction of a new learning disability daycare centre and dementia daycare centre?

9.MOTIONS ON NOTICE - To consider the following Motions submitted under Rule A12:-

i) by Councillor Mrs Newbound

Royal Berkshire Fire Authority is encouraging a greater uptake of sprinkler systems by registered social landlords, and in properties where vulnerable members of the community reside.

This Council supports improving safety and therefore requests Cabinet, working with Building Control, to examine how risks to occupants can be minimised by pre-cautionary measures such as sprinklers

ii) by Councillor Werner

This Council notes the Secretary of State for Justice comment that simply locking people up for the sake of it is a waste of public funds.

This Council supports the coalition government's attempt to stop the revolving door of crime and reoffending.

Therefore the Council resolves to write to the Secretary of State offering its full support to create a more intelligent, consistent. and transparent system of sentencing

iii) by Councillor Burbage

This Council notes the success of the coalition government in Westminster. This Council would like to congratulate the leaders of both coalition parties on their determination to put the national interest above their party differences.

This Council recognises the necessity of spending cuts and recognises the importance of agreement on a cross party basis to take the necessary steps while seeking to get the best outcome for the residents of Windsor and Maidenhead.

iv) by Councillor Mrs Bateson

This Council notes the lack of broadband access in rural areas, both within and outwith the Royal Borough, and recognises that this is an impediment to encouraging wider internet access to target groups and their education, lifestyle and rural businesses.

This Council resolves to write to the Coalition Government asking that the installation of Broadband in rural areas be made a priority
