YOU ARE HEREBY SUMMONED TO ATTEND the Meeting of the Council of the Royal Borough of Windsor & Maidenhead to be held in the Council Chamber at the Town Hall, Maidenhead, on Tuesday 21 April 2009 at 7.30 pm for the purpose of transacting the business specified in the Agenda set out hereunder.

1. APOLOGIES FOR ABSENCE

To receive any apologies for absence.

2. COUNCIL MINUTES

To receive the minutes of the meeting of the Council held on 24 February 2009.

3. DECLARATIONS OF INTEREST

To receive declarations of interests in respect of any item to be considered at this meeting.

4. MAYOR'S COMMUNICATIONS (15Kb PDF) - To receive such communications as the Mayor may desire to place before the Council

5. PETITIONS - To receive any petitions presented by Members on behalf of registered electors for the Borogh under Rule A.10.

6. MEMBERSHIP OF THE STANDARDS COMMITTEE PARISH SUB-COMMITTEE (30Kb PDF) - To consider two vacancies on the Parish Sub-Committee of the Standards Committee and approve appointments to these vacancies.

7. AMENDMENTS TO THE COUNCIL CONSTITUTION (44Kb PDF) - To consider proposed amendments to the Council Constitution. Appendix 'A' (11Kb PDF); Appendix B (26Kb PDF)

8. REVIEW OF DESIGNATED PUBLIC PLACES ORDER (ALCOHOL CONSUMPTION) (38Kb PDF) - To consider a recommendation from Cabinet on the revocation of two existing Designated Public Places Orders.

9. MEMBERS' QUESTIONS - To receive Questions submitted under Rule 11.2

a) Question submitted by Councillor Dudley to Councillor Rayner, Lead Member for Highways and Streetcare: Would the Lead Member please confirm the status of discussions to remove unsightly boats moored on the Taplow side of the Thames adjacent to the Skindles and paper mill sites and also along the eyots overlooked from Ray Mead Road?

b) Question submitted by Councillor Adams to Councillor Dudley, Lead Member for Adult and Community Services: Will the Lead Member confirm to this Council that the dog bins in the Royal Borough will not be removed?

10. MOTIONS ON NOTICE - To consider the following Motions submitted under Rule A12

i) by Councillor Werner

This Council is concerned by the Identity Card Act 2006 as it believes

1. The use by Government of the ID card and database will have a detrimental effect on the relationship between the individual and the state.

2. The scheme will impose wholly disproportionate implementation and operational costs on the Council

3. The scheme's likely damaging effect on Royal Borough's residents.

This Council resolves unless required to do so by law to take no part in any pilot scheme or feasibility work in relation to the National Identity Card Scheme.

ii) by Councillor Mrs Newbound

This Council notes the campaign for a new Post Bank launched last month, supports using the existing Post Offices as a financial network, and welcomes the provision of a stable financial source for society and businesses that a Post Bank would bring.

Accordingly it resolves that a joint letter from the Leaders of the Council and the Opposition be sent to central government and local M.P's urging them to support fully this policy.

iii) by Councillor Burbage

On Tuesday 6th April an incident occurred at Alexandra Gardens, after the opening of the Windsor Wheel, an event which a number of Councillors and officers were attending. This incident could have easily developed into a very serious situation had it not been for intervention by Council Members. The police response was limited.

This Council notes with concern the incident at Alexandra Gardens on the evening of the opening of the Windsor Wheel.

This Council commends the public spirit and bravery of Councillor Maxwell and Councillor Bicknell, family and colleagues in attempting to stop violent behaviour, and restrain those involved.

This Council regrets lack of presence of the Thames Valley Police at the event, the lack of a nearby police resource in the town, and the general lack of resources allocated to ordinary policing in the Royal Borough, and asks the Chief Executive to notify the Thames Valley Police of this motion.

iv) by Councillor Rayner

In respect of SouthWest Trains: This Council notes the usage of 20 year old rolling stock that do not contain toilets, or first class carriages, and are more difficult to access for disabled/mothers with pushchairs and young people on the Windsor to Waterloo line.

This Council requests that the Chief Executive writes to South West Trains, copying to Adam Afriyie MP, requesting an explanation and to ask for the reintroduction of modern rolling stock.

11. LOCAL GOVERNMENT ACT 1972 - EXCLUSION OF PUBLIC - To consider passing the following resolution:-

"That under Section 100(A)(4) of the Local Government Act 1972, the public be excluded from the remainder of the meeting whilst discussion takes place on item 12 on the grounds that it involves the likely disclosure of exempt information as defined in Paragraphs 1-7 of part I of Schedule 12A of the Act"
