YOU ARE HEREBY SUMMONED TO ATTEND the Meeting of the Council of the Royal Borough of Windsor & Maidenhead to be held in the Council Chamber at the Town Hall, Maidenhead, on Tuesday 23 September 2008 at 7.30 pm for the purpose of transacting the business specified in the Agenda set out hereunder.

1. APOLOGIES FOR ABSENCE

To receive any apologies for absence.

2. COUNCIL MINUTES

To receive the minutes of the meeting of the Council held on 29 July 2008.

3. DECLARATIONS OF INTEREST

To receive declarations of interests in respect of any item to be considered at this meeting.

4. MAYOR'S COMMUNICATIONS (77kb Word) - To receive such communications as the Mayor may desire to place before the Council.

5. PETITIONS - To receive any petitions presented by Members on behalf of registered electors for the Borough under Rule A.10. Councillor Mrs Herdson has given notice of a petition, which requests the Borough Council to improve pedestrian safety under Norden Road Rail Bridge, Maidenhead.

6. STANDARDS COMMITTEES - LOCAL ASSESSMENT OF COMPLAINTS (45kb Word) - To consider the Standards Committee (England) Regulations 2008, issued by the Standards Board for England, in respect of the local assessment of complaints.

b) Question submitted by Councillor Fido to Councillor Mrs Bateson, Vice-Chairman of the Berkshire Fire and Rescue Service (BFRS) Executive Committee:

As Vice-Chairman of the BFRS Executive Committee, will Councillor Mrs Bateson please inform Members if she will be supporting this Council's case at the forthcoming Judicial Review or the Fire Authority's intention to defend the consultation process undertaken concerning the withdrawal of night time service at Windsor Fire Station?

c) Question submitted by Councillor Fido to Councillor Dudley, Lead Member for Adult Services:

Having taken six months to prepare a report which has now decided not to issue bus passes to the Borough's carers in the current financial year, would you please explain why it is the less-advantaged residents who are having to suffer to pay for our much vaunted but increasingly besmirched 2.4% council tax increase?

d) Question submitted by Councillor Majeed to Councillor Rayner, Lead Member for Highways, Transport and Environment:

Could Councillor Rayner please inform the Council as to the current status of the issue of the routing of the Thames Path on Ray Mead Road?

8.MOTIONS ON NOTICE

To consider the following Motions submitted under Rule A12 (procedural note on page v for reference purposes):-

i) by Councillor Lenton

This Council noting that December 9th 2008 will be the Four Hundredth Anniversary of the birth of John Milton, one of England's greatest literary figures, moves that, on that day, as part of the national celebrations, there should be a Civic Event in Horton to commemorate John Milton who lived in Horton from 1632 to 1634. The Civic Event should include the installation of a plaque at Berkyn Manor Farm where John Milton lived and a Church service at St Michael's Church, Horton during which a wreath would be placed on the tomb of John Milton's Mother.

ii) by Councillor Baskerville

This Council applauds the truly outstanding achievements of Team GB, and in particular the Olympic and Paralympics cyclists, on their recent successes in Beijing and supports future initiatives by this Borough to encourage more people, and especially children, to take up this pastime to aid fitness and ease road congestion.

iii) by Councillor Mrs Napier

This Council notes and supports the campaign from home workers to have the same legal rights as office and factory workers.

This Council will contact its local Members of Parliament urging them to sign Early Day Motion 1123 in support of this campaign.

iv) by Councillor Mrs Newbound

The cross party Local Government Association Small Change Big Difference campaign seeks to provide council leadership on climate change.

This Council fully supports the arguments and lobbying undertaken by them in the last few months when energy prices to Borough residents have been rising sharply.

This Council is particularly supportive of greater home insulation being financed in part by energy companies.

v) by Councillor Mrs Proctor

This Council supports wholeheartedly the RBWM LSP Compact and undertakes to make sure that officers who have contact with the voluntary sector are made fully aware of the compact on a regular basis.

vi) by Councillor Maxwell

This Council recognises that many residents experience significant amounts of aircraft noise and that there is a limit to the amount of noise and discomfort which is acceptable, especially where childrens' sleep patterns are disturbed. With BAA and the Government's desire to increase capacity at Heathrow, there are concerns that night flights will increase over the Borough to the detriment of residents.

This Council moves:

  1. That The Royal Borough reaffirm opposition to night flights from Heathrow and works with other members of the 2M Group to oppose night flights from Heathrow.
  2. That the Royal Borough lobby BAA and the Government to ensure that residents', and particularly childrens' quality of life is not further lessened by more aircraft noise.
  3. That the Royal Borough oppose any measure taken by BAA which would impact on the educational welfare of young people in the Royal Borough.
