Lawful basis for processing information
The lawful basis for processing under Article 6 GDPR 2018:
General Data Protection Regulation Article 6(1)(c) processing is necessary for processing is necessary for compliance with a legal obligation to which the controller is subject.
General Data Protection Regulation Article 6(1)(e) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Processing of special category data is necessary for reasons of substantial public interest in accordance with the Equality Act (Article 9(2)(g).
How we collect information
We collect personal data directly from residents when they participate in the consultation process either online or by completing paper forms available at RBWM Libraries.
Public Spaces Protection Orders (PSPOs) deal with nuisance in a particular area where this is a detrimental effect on the quality of life for those in the local community.
PSPOs can prohibit specific activities from taking place or require a specific action to be carried out.
We are proposing PSPOs to tackle:
- Dog fouling and dog control.
- Cycling on the highway in pedestrianised zones in King Street/High Street, Maidenhead and Peascod Street, Windsor to only apply during the hours of 10am to 5pm daily.
We are seeking the views of residents and visitors of the Borough via public consultation to gauge whether there is enough support for PSPOs to be put in place.
The public consultation is a statutory requirement before a PSPO can be put in place.
Categories of information
Residents are asked to supply their post code, age, gender, race and disability when providing personal information during the consultation process for the purpose of introducing PSPOs.
We rely on the legal basis of consent should residents wish to be contacted about a PSPO consultation, in which case the resident may choose to supply additional personal information such as their name, email or contact number.
How we use the information provided
Information provided by residents as part of the consultation will be anonymised and collated to create our consultation report to indicate where there are community safety issues.

How long we store your information
Your personal data is held by the team for 12 months and then securely destroyed.
