LGPS Regulations

The regulations governing the LGPS are set out in three separate and distinct sets of legislation:

As amendments are made to the regulations, via amending statutory instruments, these timeline regulations are updated to reflect the changes that have been made.
The regulations can therefore be read as they stood both before and after the changes are made.

GAD Guidance - Choice of Early Payment of Pension and Flexible Retirement

Under Regulation 30(4) and 18(2) of the Local Government Pension Scheme Regulations (Benefits, Membership and contributions) 2007 ("the Benefit Regulations") (SI. 1166 of 2007), effective from 1 April 2008, the Government Actuary's Department (GAD) is required to issue guidance to determine on the appropriate amounts by which a member's retirement pension and grant should be reduced in respect of early payment.

A member may also have a transfer credit that was awarded under protected regulation 66(5) of the Local Government Pension Scheme Regulations 1997 ("The 1997 Regulations") (SI 1612 of 1997) protected by virtue of 66(8) of the 1997 Regulations. This guidance also applies for reductions applied in respect of those transfer credits.

GAD Guidance - Trivial Commutation of Pension

Regulation 39 of the Local Government Pension Scheme (Benefits, Membership and Contributions) Regulations 2007 (SI No.1166 of 2007) permits an administering authority to pay a lump sum representing the capital value of a small pension to a member, or surviving dependant of a deceased member, as appropriate if it qualifies
as a trivial commutation lump sum or a trivial commutation lump sum death benefit defined by sections 166 and 168 of the Finance Act 2004.

The tables below have been provided by the Government Actuary's Department (GAD) to enable authorities to calculate the lump sum payable in these circumstances.

GAD Guidance - Purchase of Additional Pension

Under Regulation 14 of the Local Government Pension Scheme (Benefits, Membership and Contributions) Regulations 2007 ("the Benefits Regulations") (SI 2007/1166), a
member may elect to make additional contributions to the LGPS to be credited with additional pension.

Regulations provide that the amount of the additional contributions paid by a member purchasing additional pension must be the amount for the time being as is shown in guidance issued by the Government Actuary's Department (GAD) outlined in the following tables.
